Terms of service

Usage. The data collected by HMS will be used for the following purposes:

  1. Facilitate marketing
  2. Market research
  3. Produce statistical data

Data contained herein may not be shared in part or in whole with anyone other than subscribing members. This includes but is not limited to real estate professionals, title companies and their underwriters, home warranty companies, customers, and attorneys except in the conduct of the subscriber’s business. Lender Recovery Services and its parent, Home Marketing Systems Inc. (HMS), reserve the full right to market and sell access to these data as it sees fit and no use therein will be considered to reduce the value to the subscriber. The data as presented as well as the system on it’s web site made available to the subscriber, at all time, remains the property of Home Marketing Systems Inc. HMS will from time to time delete old records from the system. HMS agrees to supply Subscriber upon request with any record they may need as a result of a working relationship with the party of record for up to six months from the time of elimination from the database.

Duplication. No reproductions, other than the worksheets designed by HMS., property by property as self generated computer records and hand written notes, shall be made of these records without the prior written consent of HMS.

No Representations or Warranties. Subscriber understands that these data are not confidential and are part of public record. HMS has compiled these records for your use but makes no representation or warranties whatsoever expressed or implied, with respect to their content, completeness, accuracy or suitability for the purposes intended by the subscriber. Subscriber hereby releases HMS and the respective agents, officers, directors, attorneys, employees, contractors and representatives from all claims, causes of action, losses, damages, liabilities, judgements, costs and expenses ( including, without limitation, attorney’s fees, whether suit is instituted or not ) asserted against or incurred by Subscriber as a result of Subscriber’s use. Subscriber acknowledges that, by the very nature of this information, data will become outdated and unusable at a point in time and will be eliminated from the database. Except as agreed to above, HMS will not be held liable for information lost by Subscriber after the elimination time frames have expired.

Legal Requirements. Subscriber acknowledges that in the normal course of their business, confidential information may be shared by the person or persons referred to in the record. Subscriber agrees to abide by the Right to Financial Privacy Act and any other state or federal privacy acts or common law. Subscriber agrees to not lead persons referred to in the record to believe data provided by HMS has any confidential information controlled by any privacy laws.

Payment. Subscriber agrees to pay its fee for usage prospectively and acknowledges that failure to do so will result in temporary suspension of Subscriber’s account.

Representations. Subscriber represents that they are in good standing with the licensing agency to which they are or may be responsible in the state of jurisdiction where Subscriber operates.
